The Body Mechanic Online Terms & Conditions

Please read the following terms and conditions carefully: Welcome to YourBodyMechanic.com. The exercise system is referred to as “DPT”. The women’s self-defense system is referred to as “GIRL Power”. This website is owned by The Body Mechanic, which is a DBA of Perfect Fit Inc, a business located in Cary, NC. This Terms and Conditions Agreement (this “Agreement”) sets forth legally binding terms for your use of the Website. By using our Website, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse our Website) or you are a “Member” (which means that you have registered as a user). If you do not accept the terms of this Agreement, you should not use our Website. We may modify this Agreement from time to time, and such modification shall be effective upon its posting on any part of our Website. You agree to be bound by any modification to this Agreement when you use any part of our Website after any such modification is posted; it is therefore important that you review this Agreement regularly.

Agreement between the Member (or Visitor) and The Body Mechanic (TBM)

1. General requirements for becoming a member

Reading and accepting this Agreement is a pre-requisite to becoming a Member at this Website. By accepting this Agreement, you represent the following:

  • You are at least 18 years of age

  • You are not barred from engaging in a legal contract in the United States of America

  • You are providing information that is true and accurate in our registration process

  • You are healthy enough to participate in an exercise regimen

  • You will not share your account with another person or entity, or otherwise allow another person or entity to use your account to access our Website

If the Member is found to be in violation of any of the aforementioned criteria, TBM reserves the right to suspend or terminate your account. Membership on our Website is void where prohibited.

COVID-19 Liability Disclaimer:  If you have been exposed to COVID-19 and quarantined, you should not participate in any of our programs until you have been released from quarantine by a medical professional.  You certify that the aforementioned is true.

Health Warning and Liability Disclaimer:  Before starting this or any other exercise program, you should first consult with your physician or other health care practitioner. You should not take anything posted on this Website (including video, audio, or written content) as medical advice. Your use of our Website and services is at your own risk. Perfect Fit Inc, The Body Mechanic and any of its affiliates can not be held liable, in any way whatsoever, for liabilities of any kind resulting from use of this Website.

Use of Content:  Content on the Website is provided to you as is for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of TBM. TBM reserves all rights not expressly granted in and to the Website and the Content.

Participation in classes and programs:  Classes are subject to cancellation if a minimum of three (3) students are not registered within 12 business hours of class start time. Member must sign up online ahead of time for a class.  Member is required to arrive in plenty of time to be ready to go when class starts. Doors will be locked at the start of class.  Any class is subject to be cancelled if there are insufficient registrants. Member should check the web site one hour prior to class start time.  Classes are non-transferable.

Participation in private sessions:  All Tune-ups purchased are good for one year from the date of purchase, unless otherwise stated.  Because of the base value of a Tune-up, you have the freedom to schedule a session for any length that is a multiple of 15 minutes (i.e. sessions lasting 15 minutes, 30 minutes, 45 minutes, etc.)  Tune-ups are non-transferable.

Text message opt-in:  By providing a mobile phone number, the member agrees to receive text messages from TBM.

2. Member Account and Security

The Member is responsible for maintaining the security of the Member’s account information, including but not limited to the username, email and password. The Member is also fully responsible for any and all activities that occur the Member’s account.

3. Code of Conduct

You may not upload or post any content (including but not limited to video, audio, pictures or text) that:

  • Contains profanity or otherwise hateful language

  • Contains pornography

  • Infringes on any party’s copyrights

  • Exploits minors

  • Contains any viruses or otherwise harmful software

  • Depicts any illegal activity

 

Further, you may not:

  • Harass any other member on our Website

  • Distribute or promote “spam”

  • Solicit other Members to purchase products

  • Re-distribute or sell any part of the products or services on our Website

 

TBM reserves the right to alter or delete any content, at its discretion.

4. License to Your Content and Content Created by TBM

By posting or otherwise making available any content to or via our Website, or by participating in any programs offered by TBM, you hereby grant TBM a non-exclusive, fully-paid, royalty-free, perpetual, irrevocable, worldwide license (with the right to sublicense through unlimited levels of sublicensees) to use, copy, modify, adapt, translate, create derivative works, publish, publicly perform, publicly display, store, reproduce, transmit, distribute, and otherwise make available such Content on and through our Website, in print, or in any other format or media now known or hereafter invented, without prior notification, compensation, or attribution to you, and without your consent.

5. Term and Termination

Term:  This Agreement shall remain in full force and effect for so long as it is posted on any part of our Website.

Termination:  You may terminate your account at any time, for any reason, by following the instructions on the Website. TBM reserves the right to terminate your membership or your access to our Website immediately, with or without notice to you, and without liability to you, if TBM believes that you have breached any of the terms of this Agreement, furnished TBM with false or misleading information, or interfered with use of the Website by others.

6. Privacy

All services are subject to TBM’s Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
